General Terms and Conditions

The terms and conditions and other policies on this page are correct at time of publishing. These terms and conditions are based on trust between us and clients, and on transparency on our part. As such, they aren't intended to be onerous.

'Matt Hrkac Photography' (thereafter referred to as 'we', 'us' or 'the business') is a registered business name with the Australian Securities & Investment Commission (ASIC) and operates under the ABN: 55 481 801 961. Its registered business location is in Collingwood, VIC 3066. See details. All clients who engage with our services agree to these Terms and Conditions; and it's the responsibility of any client or prospective client to review these Terms and Conditions when choosing to engage our services.

Use of work for promotional purposes

The business reserves the right to use any images or footage that it acquires in the course of carrying out its work to promote the business and its services to other prospective clients. Copyright of all images and footage remains with their creators.

Commissioned work, such as that for commercial or personal branding work, will require clients to sign a release form. 

Identifiable individuals featured in images may request that those images be removed from any platforms that we control by emailing [email protected].

Licensing of images and video footage

Clients may license the use of any video footage or images produced by Matt Hrkac Photography. A client can do this by:

  • Identifying how the image or footage is going to be used (e.g. for profit or educational/illustrative/not for profit).
  • Paying the relevant advertised and quoted fee.
  • (If applicable) paying the required renewal fee due at the end of each year, from initial purchase of the license, for as long as the image or footage remains in continued use.

Pricing changes

The business will, from time to time, review its pricing across all of its service offerings. In the event that the business agrees that there be a change of pricing, this will be notified on the website.

In the event of a price increase; pricing of all already issued quotes will be honoured under the pricing structure that they were issued. The increase applies only to new quotes issued from and after the date that the price increase comes into effect.

For price decreases: all issued quotes will be revised down to the new pricing structure. This doesn't apply to invoices issued for already completed work.

Discounts and promotions

The business may, from time to time, advertise discounts and promotional offers. Details of these will be advertised on the website as appropriate. Discounts and promotions only apply for services provided during the advertised promotional period and subject to the terms and conditions of the offer.

Deposits

The business reserves the right to require clients pay a deposit before confirming any provision of services. The deposit paid will be no greater than 50% of the quoted price and must be paid up to 14 days in advance of a service taking place. In the event that the deposit isn't paid where required and by the required deadline, we reserve the right to not provide the agreed service.

Current deposit policy is as follows:

A 50% deposit will be payable on the quoted price in the following circumstances:

  • First time clients for jobs longer than 4 hours in duration, or;
  • First time clients for jobs greater in value than $1,500.
  • Repeat clients requesting services who have a history of not paying invoices promptly, no shows and other means of inconveniencing us.

Invoices

Final invoices are due on receipt. In the event of invoices not being paid, the following process will take place:

  • A reminder follow up to the client 2 weeks after the invoice is issued.
  • If the invoice is still not paid, a second reminder will be issued a week after the initial reminder.
  • If the invoice is still not paid and no justifiable reason has been given in the next week - we understand that things happen that are out of the client's control - an interest rate of 2% will be appled to the final invoiced amount.
  • This interest will accumulate by 2% every 4 weeks until the final invoice is paid.
  • If in the event that the final invoice still isn't paid, Matt Hrkac Photography reserves the right to engage debt collection and other legal means - with such costs covered by the client - to recover the amount plus any accumulated interest owed.

Postage and handling

For physical items, we charge a $9.95 flat postage fee up front for postage within Australia. We mail via AusPost Standard from Victoria, which gives a postal delivery time of 2-7 days depending on your location. Pick up of physical items is available in Geelong or Melbourne (inner northern suburbs) via arrangement with the customer.

Returns can be mailed, at customer cost, to PO Box 222, Fitzroy VIC 3065 CC: Matt Hrkac Photography. Refunds are not available.

Refunds

Deposits are refundable only in the event that the service can no longer be provided; such as illness, incapacitation, or similar on part of the service provider. Deposits don't cover change of mind (outright cancellation) on part of the client.

Deposits carry over for change of dates provided that we're informed at least 7 days in advance. If a change of date is requested within 7 days, the deposit is waived, and a new 50% deposit will be required. The new 50% deposit comes off the total quoted price. The business, at its discretion, reserves the right to charge an additional surcharge.

As payment is for our time, there are no refunds available on final invoices.

Statement of ethics

We have a policy of "do no harm", "promote no harm" and telling the truth and ensuring accuracy. We know, in our line of work, that we can be powerful tools in allowing individuals, organisations and businesses to effectively promote and market themselves, or sanatise themselves.

We have a screening policy for the types of people, organisations and businesses we seek to do business with. We don't do business with anyone or entity that seeks to harm people and the planet.

That means, we won't work with any of the following:

  • Fossil fuel companies, or individuals otherwise involved in the leadership of such companies, or organisations that actively promote and support the continued use of fossil fuels.
  • Companies, businesses, organisations and individuals that directly profit from and actively support war and the weapons industry.
  • Tobbacco and other similar companies that manufacture and profit from products that are a detrement to human health.
  • Police Forces and the Defence Force.
  • "Fringe" right-wing politicians or right-wing political candidates.
  • Organisations and entities that actively support, endorse or promote harmful political views and ideologies.

There are times where clients, who otherwise don't fall into any of the above, engage with people or entities from the above. An example of this: a corporate event we've been hired to shoot invites a politician to speak who we strongly disagree with.

That doesn't preclude us from working with such clients. Under this statement, it simply means that we wouldn't take on as a client any entity that falls into the above.

Copyright

All images published on this website and otherwise, accounts and assets we control, are copyrighted. Republishing images without first seeking and being granted permission; or if applicable, paying the relevant fee; or republishing images not in line with the agreed terms, is strictly prohibited.

Customers and clients wishing to use and republish images can do so by paying the relevant fee for the image or through reaching mutual agreement.

Tied in to our privacy policy, any person featured and easily identifiable within an image has every right to request that the image be taken down or made private. Individuals wishing to have an image prominently featuring them to be taken down can do so by contacting us. Note that these take down requests must come from the individual themselves, not from friends or otherwise on behalf of the individual. Note also that although we can action take down requests on images uploaded onto accounts and services we control, we can't take action on instances of images used on third party websites unless that image is being used in bad faith.

For events taking place on public land - individuals don't have an assumed right to privacy and as such there'll be no effort made on the ground to seek permission or check for permission prior to images being uploaded and circulated unless a prior arrangement (i.e. images to be taken at an event for a specific purpose) has been entered into.

We reserve the right to update these policies at any time.
